It's been some months now since I originally posted this topic, but I wanted to let anyone interested know that my petition for radical sanation was approved! The reason it took so long was that the deacon I was working with was waiting on the diocesan tribunal to let him know what papers to fill out/submit. Since radical sanation isn't commonly done, no one seemed to know exactly how to handle it. But once the papers did get filed, it didn't take all that long for our answer. It didn't cost anything, by the way, except time. Fortunately, I was granted a great measure of patience to deal with the wait!
I wasn't able to get confirmed at Easter with the rest of my RCIA class, nor was I allowed to take first holy communion. However, now that the petition has been granted, I am free to participate in the sacraments. My confirmation will be soon---July or August.
So now I'm off to read about the sacrament of reconciliation, since that is the next step I must take!

Kim,
I have been reading your story with interest, as I am in an "irregular marriage" situation also.
I was raised as a Jehovah's Witness. My husband was cradle Catholic, participated in all the sacraments, attended Catholic High School, then left the Catholic Church. He wrote a letter to his home parish attempting to terminate his membership (prior to his being baptized as a JW); they informed him (of course) that baptism is forever. We met after he became a JW and married. We've been married for over 33 years and are in our mid-fifties.
Now, in one of those strange twists of fate that God hands us, I am pursuing Catholicism :-) The cradle JW plans to start RCIA in August.
Because I am married to a lapsed Catholic, my marriage is "irregular".
My husband says that he will never set foot in a Catholic Church again. I pray constantly that the Lord will change his mind (and heart), but I am also afraid that he will blow his stack on being asked to have our marriage convalidated. In addition to his still viewing himself as a JW (although he has been inactive for years), there was some difficulty that his brother had with their home parish at the time he wanted to get married. So his bias against marriage in the Church is both religious and personal and familial.
His opposition to me has so far been somewhat mild, but with a strong "don't ask me to do anything!" In other words, he's not helping me but he's not blocking the way. Convalidation, however, would require him to "do something". I am willing to pray and ask him, but I need to be prepared with a Plan B if he decides that this is his way of preventing me from becoming Catholic.
I may need to ask for a "radical sanation" in order to become Catholic. Is there any information you could pass on that might help me to expedite the matter if it becomes necessary? I've already discussed this a little with the Deacon who leads RCIA and he seems never to have heard of this procedure.

Since your marriage appears to be invalid because of a defect of legitimate form, suggest that he review Canon Law beginning at Canon 1161, and in particular:
| Can. 1163 ยง1. A marriage which is invalid because of an impediment or a defect of legitimate form can be sanated provided that the consent of each party perseveres. |
